Apalachee High School shooting suspect Colt Gray appeared in Barrow County District Court on Friday after this last week’s mass shooting.

According to the Georgia Bureau of Investigation, Gray “has been charged with four counts of murder in connection with the shooting” at Apalachee High School in Barrow County. However, the judge says he will not be sentenced to death.

“I want to point out to you that the maximum penalty for first-degree murder. So for each charge, the maximum penalty is that you could be punished by the death penalty, by life imprisonment without the possibility of parole, or by life imprisonment with the possibility of parole,” Judge Currie Mingledorff II originally told Gray during the hearing.

However, the judge quickly reversed that ruling, stating that the maximum sentence for Gray does not include the death penalty.

Mingledorff said no bail will be requested for Gray at this time.

Gray did not file a request during his appearance.

An attorney representing Gray also told the judge that “there was a development yesterday afternoon that made it necessary for our office to appoint a replacement attorney, and arrangements have already been made in that regard.”

“I have already explained that to Mr. Gray. The alternate counsel will be appointed by the end of the day,” she added.

The suspect’s father, Colin Gray, appeared in court shortly after his son for a separate hearing.

Colin Gray was arrested Wednesday and charged with two counts of second degree murderfour counts of involuntary manslaughter and eight counts of cruelty to children, according to the Georgia Bureau of Investigation (GBI).

“For the felony murder counts… the maximum penalty for each count is up to 30 years in prison,” Judge Currie Mingledorff II said. “For felony involuntary manslaughter… the maximum penalty for each of those offenses is 10 years in prison.”

“For the eight counts of child abuse, the maximum penalty under the law for each of those eight counts is 10 years in prison. The maximum total possible penalty for the charges you currently face is 180 years in prison,” the judge concluded.

Gray was seen rocking back and forth in his chair after the judge spoke. The preliminary hearing in his case, like his son’s, is set for Dec. 4.
