LOS ANGELES (KABC) — Family member after family member called them victims instead of villains and called for the release of Erik and Lyle Menendez, who are currently serving life sentences for the 1989 murders of their parents in Beverly Hills.

A news conference Wednesday in Los Angeles was the multigenerational family’s largest gathering since the brothers’ conviction.

But not every family member believes the brothers should be released. Kathy Cady is a victims’ rights attorney representing Milton Andersen, Kitty Menendez’s brother.

“Mr. Andersen is confident that his cousins ​​were not abused,” Cady told Eyewitness News. “He believes this is a fabrication and he believes the motive was pure greed.”

Lyle Menendez, who was 21 at the time, and Erik Menendez, then 18, admitted to fatally shooting their father, Jose Menendez, and their mother, Kitty Menendez, but said they feared their parents were about to kill them. murder to prevent the murder. revelation of Erik’s long-term sexual molestation by the father.

Prosecutors argued at the time that there was no evidence of sexual assault, and many details in their sexual abuse story were not allowed in the trial that led to their conviction. The district attorney’s office said at the time that the sons were after their parents’ multimillion-dollar estate.

Cady says Andersen, who is now 90 years old, wants the brothers to remain in prison and serve their life sentences, at least for the murder of his younger sister.

“At the time of the trial, one of the brothers said, at least according to the appellate court’s opinion, that killing her was a mercy killing,” Cady said.

The latest move to free the brothers comes after the two’s attorney submitted new evidence that he claims helps prove their father sexually abused them.

But Cady says this was filed over a year ago, and that District Attorney George Gascón is now using the case to gain political support as he approaches the election.

“Mr. Andersen just wants to make sure that whatever decision is made, it is not politically driven, but it is truly made for the right reasons,” Cady said.

Cady also says – contrary to California law – that Andersen has been overruled by the prosecution and has no input into the fate of his sister’s killers.

Gascón’s office declined to comment on Andersen’s lack of involvement.

“Mr. Andersen understands that he will not be the one to make the final decision, but he wants to make sure that the person making the final decision will not forget him,” Cady said.

Andersen’s attorney says they have sent a letter to Gascón asking him to meet with the district attorney before a decision is made. They haven’t heard anything back.
