It may have seemed like a lawsuit at first, but the Elon Musk-backed “free speech” case of Gina Carano vs. Disney isn’t exactly going away, and things continue to tilt in the actress’ favor.

Carano was fired in 2021 after a number of controversial comments on social media, ranging from anti-trans rhetoric to claims that conservatives were persecuted like Jews during World War II. But the idea she presents is that Disney had no real reason to fire her given the nature of her contract, and she claims that sex discrimination is a reason for the firing because her male co-stars were not scrutinized for their’ personal political beliefs’. .”

Now a court had denied a request to allow Disney to delay the case, saying their previous request for dismissal had been denied. This time, the court said that Disney cannot obtain a stay of proceedings or summary judgment. In short, this is on its way to court, albeit not until September 29, 2025.

Unable to keep things from spiraling out of control, Disney has resisted in other ways, though none seem to be working. This doesn’t necessarily indicate that they would lose the case itself, but rather that their initial tactics are not yielding results here. Carano issued a triumphant statement on social media after the decision:

“I am obviously very pleased with the opportunity to continue to make progress in the judicial process and in discovery,” Carano said. “While I wish this were not necessary, as it is not my desire to be present in this battle in court, I will not shy away from it because it is difficult or uncomfortable.”

Carano is seeking damages as a result of the situation, but most surprisingly, she is seeking an injunction that would allow her to return to her job, which would require Disney to rehire her to play Cara Dune in The Mandalorian , where she had a supporting role. . Of course, this seems like the most absurd part of the case, since Carano forcibly persuading Disney to rehire would result in: what exactly? What are the rules for something like that? Can they hire her back and drop her into a Sarlaac pit in the first few minutes of her performance? Would she mandate her amount of screen time through the order? That seems almost impossible to consider. And it’s not even clear that The Mandalorian will return for a new season after the upcoming theatrical film Mandalorian and Grogu. Could she force them to put her in there? This part of this whole thing still seems like the biggest reach. Damage seems more likely if she wins.

Legally, it is anyone’s guess what is really happening here, but the courts are taking this seriously and it will come to trial within a year. It should be interesting anyway, but it would be a miracle if we actually see Cara Dune on screen again somehow.
