Can Donald Trump run again in 2028?

Legally, Trump would be constitutionally barred from running again in 2028 if he wins. The restriction is rooted in the 22nd Amendment to the U.S. Constitution, which prohibits any president from serving more than two terms. This is the case even with non-consecutive terms.

Rules on term limits

The 22nd Amendment, passed in 1951, was enacted in response to President Franklin D. Roosevelt’s unprecedented four-term presidency. The amendment specifically states, “No person shall be elected President more than twice,” effectively limiting a president to two four-year terms, whether served consecutively or non-consecutively.

If Trump wins the 2024 election, it would mark his second and final term, as he previously served from 2017 to 2021. Consequently, he would be ineligible for re-election in 2028 under the terms of the 22nd Amendment.

While some supporters have expressed interest in the idea of ​​Trump serving an additional term above the two-term limit, any efforts to repeal or amend the 22nd Amendment would require an extensive constitutional amendment process.
