ATHENS, Ga. — A Georgia judge handed down a sentence Wednesday against Jose Ibarra, the suspect accused of killing Augusta University student Laken Riley on the University of Georgia campus in February.

The suspect was found guilty of all ten charges in total, including one charge of malice murder, three charges of felony murder, one charge of kidnapping, one charge of aggravated assault with intent to rape, one charge of aggravated assault, one charge of obstructing a 911 call, one count of tampering with evidence and one count of being a “voyeur.” Ibarra pleaded not guilty to all charges.

Riley’s family and friends cried in the courtroom as the judge announced his sentence.

Prosecutors said Ibarra, a 26-year-old illegal immigrant from Venezuela, attacked and killed Riley, a 22-year-old nursing student at Augusta University, while she was jogging along trails near Lake Herrick on the University of Georgia campus in Athens. of February 22.

“Lake Riley himself has given you all the evidence you need to find this man guilty of every single charge in this indictment,” prosecutor Sheila Ross said in her closing statement Wednesday. “She did put up a fight, and it’s a direct result of that fight that gives you all the physical evidence you need to convict him.”

“He killed her because she wouldn’t let him rape her,” Ross added.

Ibarra, 26, is charged with 10 counts in connection with Riley’s murder and a “voyeur” incident on the morning of February 22. Prosecutors say Ibarra saw Riley running past popular trials on the UGA campus just after 9 a.m. on Feb. 22, attacked her, dragged her more than 60 feet into a wooded area and repeatedly hit her in the head with a rock, striking her in the head with a rock. she died.

Witnesses stated that DNA matching Ibarra’s was found in Riley’s fingernails and on a jacket with Riley’s hair recovered from a dumpster near his apartment complex.

“To find this defendant not guilty of the murder of Laken Riley, you would have to not believe the DNA,” Ross said. “You shouldn’t believe the fingerprint evidence.”

During the rebuttal on Wednesday, the prosecutor played video footage of authorities interrogating Diego Ibarra the day after Riley’s murder, which showed Diego identifying his brother on security camera footage and the jacket with Riley’s hair on it in a dumpster behind their apartment complex on the edge of UGA’s. campus. “Of course I know my own brother,” Diego allegedly told police, according to Special Agent Lucas Beyer of the Georgia Bureau of Investigation (GBI), one of the officers who interviewed Diego.

“The facts and evidence in this case should leave you with some reasonable doubt,” Kaitlyn Beck said in her closing argument Wednesday, later adding that “while the evidence in this case is extensive, it is circumstantial.”

Many of the defense’s arguments suggested that Diego could have had something to do with Riley’s murder. Beck said in her clothing statements that “it is more than possible for one brother’s DNA to end up on another brother’s clothing.”

“I agree with the state, but Lincoln Riley was physically fit. She was fast. She could have outrun (Jose). But there is another suspect in this case who was taller, who was more physically fit, who was wearing sneakers that day contributed to the murder. And that’s Diego Ibarra,” Beck said.

However, prosecutors noted that security camera footage from a dining hall on the UGA campus where Diego worked showed Diego arriving and leaving on February 22.

Argenis and Diego were subpoenaed to testify as witnesses for the defense, but the court ultimately decided not to allow their testimony because they are currently involved in their own criminal cases. Jose’s attorney, John Donnelly, said Diego’s attorney advised that he not be allowed to testify at Jose’s trial while he is currently charged with green card fraud.

On Monday, the second day of Ibarra’s trial, the court heard a recorded jailhouse telephone conversation between Ibarra and his wife, Layling Franco, that was played aloud and translated by an FBI analyst who spoke fluent Spanish. Ibarra entered the United States illegally El Paso, Texas, in September 2022 and was released on parole to the US, ICE and DHS sources previously told Fox News.

The three brothers lived in an apartment complex less than a half mile from the campus park where Riley was running on the morning of Feb. 22. ICE previously confirmed to Fox News Digital that Jose Ibarra had been arrested by the New York Police Department a year after he entered the US in August 2023 and “was charged with acting in a manner likely to injure a child under 17 years of age and a motorcycle license violation.”

Diego Ibarra, who briefly worked at a UGA cafeteria before his arrest in February, had ties to a known Venezuelan gang in the U.S., Tren de Aragua, according to federal court documents.
