An actor best known for his roles in “Arrested Development” and “Bob’s Burgers” was sentenced Monday to a year and a day in prison for his role in the Jan. 6, 2021, attack on the U.S. capital.

Jay James Johnston, 55, was accused of joining a crowd in the Capitol’s Lower West Plaza during the riot and filming it with his cell phone. He pleaded guilty in July to one offense of civil disorder.

Prosecutors also alleged that Johnston filmed from the stage set up for Joe Biden’s inauguration. Johnston also briefly held a stolen police riot shield and joined a group effort to stop police guarding the entrance to the Capitol, according to court documents.

Prosecutors said Johnston “joined a group action against police in the tunnel, crushing a Metropolitan Police Department officer between the crowd and a door.”

The Justice Department had asked the judge to impose an 18-month prison sentence, saying Johnston had no remorse or accepted responsibility for his actions.

Johnston initially downplayed the fight in text messages to an employee shortly after Jan. 6, investigators said, writing: “The news has presented it as an attack. It actually wasn’t.”

His lawyer urged the judge to impose a light sentence, saying prosecutors had “persistently exaggerated” Johnston’s role in the attack because he is an acclaimed Hollywood actor and the government uses his status to make clear to the public to make.”

Johnston was also ordered to pay $2,000 in restitution.
