As Browns quarterback Deshaun Watson struggles to regain his old form, he has a new legal problem.

On Monday, Watson was charged in Houston with sexual assault and battery and intentionally causing emotional distress.

The allegations are strikingly similar to those against Watson in more than 20 lawsuits filed in 2021. However, the plaintiff in the new case, who filed under the pseudonym Jane Doe, alleges she went on dates with Watson. Most, if not all, of the other cases stemmed from paid massages arranged by Watson.

The lawsuit explains that the date was set for Oct. 10, 2020. Watson initially couldn’t find her apartment, the lawsuit says. He called her and allegedly began “aggressively yelling and screaming and saying he couldn’t find her apartment and that he ‘didn’t have time for this.'”

The indictment then contains the following allegations:

“When Watson finally arrived at Doe’s apartment, Doe had not finished applying her makeup, so she invited Watson to sit in her living room while she got ready. While she was in her bathroom applying her makeup, Doe left the bathroom door open and attempted to strike up a conversation with Watson, to relieve the tension from his angry outburst. Jane Doe soon began to believe that she was talking to herself because Watson did not respond.

“Jane Doe came out of her bathroom to investigate Watson’s silence and was shocked to find him completely naked on her bed, lying face down on his stomach. As Jane Doe stood there in shock, Watson turned his head and aggressively demanded that she massage him, pointing to his buttocks. Jane Doe asked if Watson meant he wanted her to massage his back, but Watson indicated that he wanted to massage his buttocks.

“Jane Doe was terrified at this point in the encounter. She was in her small apartment with a much larger man and she was still reeling from Watson’s outburst and aggression on the phone. So Doe tried to soothe Watson by rubbing his back instead of his buttocks. Watson again began to insist that she focus on his glutes. Seemingly frustrated that Doe only wanted to rub his back, Watson turned around and displayed an erection. Watson continued to demand that Jane Doe massage him, pointing from his knees to his groin. Jane Doe froze in fear, unsure of how to repel Watson’s advances without endangering her safety. Confused and frightened, she repeated to Watson that she was not a massage therapist. Watson asked her what she wanted to do instead.

“Before Jane Doe could respond, Watson grabbed Jane Doe’s leg and positioned her so that she was lying down. Watson then partially undressed Jane Doe and penetrated her vagina without consent, implied or explicit. Jane Doe felt paralyzed, unsure whether to risk her safety by attempting to stop Watson or endure his assault. Watson roughly sexually assaulted Jane Doe in a “missionary position” for several minutes before grabbing her and turning her over. Watson continued to aggressively attack Doe from behind. Jane Doe finally mustered the courage and strength to escape from Watson. Jane Doe quickly ran to her dresser to grab a heavy piece of decoration for self-defense and screamed at Watson to get out of her apartment. Enraged, Watson stormed out of Jane Doe’s apartment.”

The statute of limitations for most personal injury cases is two years. In Texas, the statute of limitations is five years because the case specifically alleges sexual abuse,

The plaintiff is represented by Tony Buzbee, who represented many others who sued Watson in 2021.

This new case raises many questions, from the standpoint of the league and the Browns. It is possible that Watson could be subject to further investigation under the Personal Conduct Policy. It is also possible that a suspension — if imposed — could provide the Browns with a path to void his remaining salary guarantees and end the relationship.

The biggest difference between the latest case and the others is that Watson is specifically accused of sexual abuse.
