Garth Brooks files to move sexual assault lawsuit to federal court

The country singer’s lawyers want to move because Jane Roe’s damages exceed regulations in federal court

Attorneys for Garth Brooks have filed a motion to move the sexual assault lawsuit against the country star from state to federal court.

The lawsuit was initially filed in October in a California superior court, but because Jane Roe’s accuser is seeking damages in excess of $75,000, it falls within federal court regulations.

Entertainment tonight reports that the shift to federal court could be beneficial to Brooks because those courts typically schedule faster trial dates, have a more settled jury pool and the judges are more “receptive to dismissing a case,” legal expert Tre Lovell told me AND.

In the express lawsuit filed in the Superior Court of Los Angeles County and obtained by Rolling stonesaid the woman — a hair and makeup artist who worked with the singer — said the first alleged battery occurred while she was at Brooks’ home for a styling appointment. She alleged that Brooks stepped out of a shower naked, “grabbed her hands and pushed them onto his erect penis,” stating that he “had fantasized about this moment and wanted her to perform oral sex on him.”

The woman said a second incident occurred when she agreed to travel with Brooks to Los Angeles for a Grammy tribute to Sam Moore. She alleged that Brooks “locked her” in a hotel room, “grabbed her hands and pulled her” onto a bed where she claimed he raped her.

In response to the lawsuit in October, Brooks claimed he was the victim of extortion and defamation. “Over the past two months, I have been harassed endlessly with threats, lies and tragic stories about what my future would be if I did not write a multi-million dollar check,” the country singer said in a statement to Rolling stone. “It was like waving a loaded gun in my face.”

Brooks later added in a Facebook Live Q&A: “This thing is on; it’s going to happen. People tell me it can take up to two years. So my suggestion is, we all take a deep breath, just sit down and let’s hold hands and journey together. Because it’s something we can’t talk about. That’s all we can say about it.”
