Garth Brooks’ rapist accuses singer of ‘sham’ preemptive lawsuit

The woman who alleged Garth Brooks forcibly raped her in a Los Angeles hotel room in 2019 is slamming the country singer’s efforts to have her sexual assault case dismissed in California.

In new court filings obtained by Rolling stoneJane Roe’s accuser is asking a federal judge to reject Brooks’ argument that her highly graphic sexual abuse suit, filed Oct. 3 in Los Angeles, is a “duplicate” of the defamation and racketeering lawsuit filed he filed against Roe in Mississippi last September.

Lawyers for Jane Roe continue to maintain that her claims belong in California, where the alleged sexual misconduct occurred. They argue that Brooks and his legal team had no right to file suit “without any notice or warning” on September 13 in Mississippi while they were actively involved in ongoing, apparently cordial settlement talks dating back to July.

“Brooks’ bad faith, sham action was nothing more than a forum-shopping maneuver,” the attorneys allege in the new paperwork filed Friday. They say the Mississippi lawsuit was “intended to pre-empt” their client’s proposed California complaint and “deny her access” to California’s anti-SLAPP statute, a law that protects against frivolous claims intended to undermine someone’s right to freedom of expression. “Brooks rushed to the courthouse to be the first to file in Mississippi – a forum he thought would be more sympathetic to him than California, in part because Mississippi has no anti-SLAPP law,” the lawyers allege.

In her lawsuit, Roe alleged that Brooks raped her in May 2019 while she worked as his hair and makeup artist for a music industry event. She claimed that Brooks, who is more than 30 pounds heavier than her, at one point held her upside down and “forcefully penetrated” her. Brooks denied this had occurred.

According to Roe, Brooks sexually assaulted her again during another trip to Los Angeles in October 2019. She alleged that he groped her body and breasts and at one point “held his crotch” while propositioning her. The woman said she was only able to escape because he arrived late and there were people waiting for him. Brooks denied ever attacking Roe.

Roe’s attorneys argue in the new filing that she deserves a California jury. “The main relevant events took place in Los Angeles, California. “No act or event underlying any of Brooks’ alleged actions occurred in Mississippi,” their papers state.

The lawyers also accuse Brooks of unmasking their client, using her real name and including photos of her in their files in Mississippi after she filed her lawsuit in Los Angeles. They say their client, following Brooks’ “underhanded vindictive tactics,” has filed her own motion to dismiss his Mississippi complaint. That case is now sealed. “This court should not reward Brooks for his bad faith tricks,” Roe’s attorneys argue in their filing Friday, asking for a denial of his motion to dismiss.

Brooks’ attorneys did not immediately respond Rollingstones request for comment sent Monday.

In his September 13 preemptive trial in Mississippi, Brooks claimed he was the victim of an “ongoing attempt at extortion.” He called the woman’s allegations “outrageous” and asked the court to declare them false. In his California dismissal filing, Brooks claimed he was the victim of “blackmail.”

“Roe asked Brooks for increasing amounts of financial assistance, which he ultimately refused to provide, and she then responded with false and outrageous allegations of sexual misconduct that she alleged occurred years ago,” his dismissal motion said. “Roe attempted to extort Brooks by offering not to publicly file her false allegations in a lawsuit in exchange for a payment of millions of dollars.”

A hearing on Brooks’ request to dismiss the California action was scheduled for December 9, but both sides have asked for it to be postponed a week, until December 16. A judge has yet to make a ruling.

In an earlier statement, Brooks disputed Roe’s allegations. “Over the past two months, I have been harassed endlessly with threats, lies and tragic stories about what my future would be if I did not write a multi-million dollar check,” the country singer said in a statement to Rolling stone. “It was like waving a loaded gun in my face.”
