Liam Payne texted his friend and designated caregiver about using drugs and having sex with prostitutes just hours before falling prey to his death – with prosecutors seeking to charge the friend with “abandonment” for failing to get him to save him from his increasing drug abuse.

Argentinian businessman Roger Nores, 35, one of three men charged in connection with the One Direction star’s death after falling from a hotel balcony in a drug-induced stupor last month, checked a total of three times a day at Payne he died, Argentine prosecutors allege in court documents obtained by TMZ.

Around 7 a.m. on Oct. 16, an already drunk Payne texted Nores and said, “Dude, I think I’m going to see a whore,” prosecutors said. About two and a half hours later, Payne texted him and asked for “6 grams” – believed to be cocaine.

Payne and Nores had breakfast together at the CasaSur Palermo Hotel in Buenos Aires, where Payne drank whiskey. Payne then went back to his trashed hotel room and frantically searched for a “powder,” according to a maid who was in the room.

A pair of prostitutes came to Payne’s room around 11:30 p.m. and had sex with him, they told police. He also asked them for cocaine because he was completely out.

He would later ask a hotel employee for “another 7 grams for today” around 2 p.m

Nores left Payne’s room shortly after 4 p.m., and around the same time, hotel staff reported hearing Payne breaking things. Someone from the hotel tried to call Nores, but he didn’t answer.

When the prostitutes demanded payment, Payne panicked and punched the television. Nores returned to the hotel around 3:45 p.m. to pay the women, by which time staff noticed that the singer appeared “visibly intoxicated.”

Nores texted Payne: “Are you okay?” at 4:25 p.m., but the star did not respond.

Nores has maintained that Payne looked fine when he left him at the hotel about an hour before he fell to his death from the balcony, sources close to Nores told TMZ.

Just before Payne’s fatal dive, a hotel employee called 911 and said they feared for his safety after having to drag him through the hotel lobby and lock him in his room. The employee indicated that he might hurt himself via the balcony to escape.

Nores was accused of abandonment for not informing the musician’s family that he had relapsed on drugs. He testified as a witness, leading a judge to rule that he breached his duty of care to Payne.

Authorities interviewed Payne’s father, who said Nores had volunteered in May to take over as Payne’s caretaker and arrange for him to go to rehab, the documents state.

Payne’s father said it was important that Payne always kept busy and was never alone during his recovery.

Earlier this month, Nores said he has “never let Liam down.”

“I went to his hotel three times that day and left 40 minutes before this happened,” he said.

“There were more than 15 people in the hotel lobby talking and joking with him when I left.”

The prosecutors who wrote the court document are national prosecutors. However, a judge has ruled that any case involving alleged “abandonment” must be handled by local prosecutors, meaning they have no legal recourse to pursue charges, TMZ reported.

To date, no charges have been filed by local prosecutors. National prosecutors appealed the judge’s ruling, but the appeal was rejected.
