Following news of the DOJ’s warning, Elon Musk’s super PAC did not announce a ‘daily’ lottery winner on Wednesday

Elon Musk’s super PAC did not announce a winner Wednesday for its “daily” giveaway of $1 million to registered swing state voters. On the same day, news broke that the Justice Department warned Musk’s group that their sweepstakes could be illegal.

The pro-Trump group, America PAC, had been publicly naming a winner since Saturday, when Musk announced he would award $1 million every day to people who sign his petition. The petition supports the First and Second Amendments to the Constitution, but more importantly, only registered voters in battleground states can sign the petition and are therefore eligible for the money.

CNN reported Wednesday afternoon that the Justice Department had sent a warning letter to the super PAC, advising that the lottery could violate federal law against offering incentives such as cash or prizes to induce voter registration, people who reported were informed about the case to CNN.

The super PAC has announced its winners with much fanfare each day, with flashy videos on social media and celebratory tweets from Musk. It is unclear whether the Justice Department letter is the reason why the super PAC did not publicly name a winner on Wednesday.

CNN has contacted the super PAC seeking comment.

Tesla’s X owner and CEO have defended the giveaway several times on social media. In response to a post claiming Musk was “paying to register Republicans,” Musk said said on X that winners “can be from any political party or none and you don’t even have to vote.” He did not address the potential legal issue of opening the lottery only to registered voters.

After Pennsylvania Gov. Josh Shapiro, a Democrat and former attorney general, said Sunday that the giveaway was “very concerning” and deserved legal investigation, Musk said posted on his X platform that it was “concerned that he would say something like that.”

The super PAC will take place on Sunday, the second day of the sweepstakes has reformulated its message around the giveaway, describing the money as payment for a job. In social media posts, the group said the winners would be “selected to earn $1 million as a spokesperson for America PAC” — and then posted pro-Trump testimonial videos featuring the winners.

However, several election law experts who spoke to CNN pointed out that the fine print on Musk’s super PAC website explaining the official terms of entry did not change.

Musk, the richest man in the world, has thrown his support behind Trump, giving more than $75 million to his pro-Trump super PAC. He has said he hopes the lottery will boost registration among Trump voters.

He made his first appearance with Trump on the campaign trail earlier this month when he called on people to register to vote and blasted Democrats as a threat to democracy during Trump’s rally returning to Butler, Pennsylvania, the site of a assassination attempt in July.

Musk also held his own town halls in Pennsylvania last week, urging voters to support Trump and promoting several debunked conspiracy theories about the 2020 election.
